1. Payment Terms:

Clients are required to make payment in full before the commencement of any services. The initial website creation fee and ongoing subscription fees are outlined in separate pricing documents. Clients who opt for annual payments will receive a discount on the standard monthly subscription fee.

2. Domain Names:

Clients are responsible for securing and maintaining a valid domain name for their website. To assist clients in this process, we offer a domain creation service for a fee. It is important to note that if a client fails to provide a valid domain name, no refunds will be issued.

3. Hosting Service:

In addition to website design services, we offer a hosting service that allows clients to create their own websites using our platform. Clients opting for this service will pay an account creation fee, and thereafter, they will be billed a subscription fee. Detailed pricing and terms for this service will be provided separately.

4. Client Responsibilities:

Clients are responsible for providing all necessary information, content, and materials required for website creation. Failure to do so in a timely manner may result in project delays and additional charges for our services.

5. Promotional Use:

We may showcase websites we've created for clients as part of our promotional materials, including but not limited to our portfolio, website, and marketing materials. Clients who wish to exclude their website from promotional use must request this in writing at the commencement of the project.    

6. Ongoing Costs:

Clients must understand that our services involve ongoing costs, including hosting, maintenance, and support. As such, once services have been initiated, no refunds will be provided for any reason.

7. Domain Name Ownership:

We do not claim ownership of domain names registered on behalf of clients. Domain names remain the exclusive property of the client, and we are committed to assisting clients with domain management as needed.

8. Editing Rights:

Clients have the right to edit their websites independently once the initial creation is complete. However, if clients request additional edits or updates beyond the initial website design, we reserve the right to charge additional fees based on the scope of the requested changes.

9. Termination of Services:

We reserve the right to terminate services for clients who violate these Terms and Conditions or engage in activities that compromise the security or integrity of our services or websites. Termination will be conducted in accordance with the termination policy provided separately to clients.

10. Limitation of Liability:

We cannot be held liable for any damages or losses incurred by clients, including but not limited to lost profits, business interruptions, or data loss. Our liability is limited to the extent permitted by applicable laws.

11. Business Continuity and Subscription Refunds:

In the event that Carter | Anderson | Shaw ceases its operations or discontinues the services before the completion of a client's subscription period, we are committed to ensuring that our clients receive the services they have paid for.

a)    Subscription Refunds: We will reimburse clients for the portion of the subscription fees that correspond to the unused period of their subscription. The refund will be calculated based on the remaining subscription term from the date of business cessation.

b)    Website Transfer: Additionally, we will facilitate the transfer of the client's website content and design to another website builder or hosting platform of the client's choice. This transfer service will be provided at no additional cost to the client, and we will make reasonable efforts to ensure the smooth transition of their website.
